Distance Sales Agreement

2. Definition of Distance Sales

This agreement is a “distance sale” under Consumer Protection Law No. 6502 (TKHK). Distance sales are concluded without the parties being physically present together, using only distance communication tools.

3. Products and Services

3.1 Product Definition

Gerçeği Arayanlar sells products in the following categories:

Crystals, stones, and minerals
Incense and aromatic oils
Guidance and consulting services
Information and digital content

3.2 Product Information

Each product listing provides:

Product name and description
Price (VAT included)
Product features and composition
Shipping fee (if any)
Stock availability
Delivery timeframe

3.3 Product Warranty

All physical products are offered with a 2-year defect warranty under TKHK. The warranty does not apply where:

The customer misuses or fails to maintain the product
Natural wear occurs
Damage results from accident or external factors
The original packaging has been opened (where hygiene/originality so requires)

4. Order and Payment

4.1 Placing an Order

The customer selects a product and adds it to the cart
Delivery and billing addresses are entered
The order summary is reviewed and confirmed
An order summary is emailed to the customer

4.2 Order Confirmation

The contract becomes binding when the order confirmation email is sent.

4.3 Payment Methods

Gerçeği Arayanlar currently accepts the following payment method:

Bank Transfer (EFT/Wire)

Payment must reference the order number
Reference: Customer Name + Order Number
Bank account details:

4.4 Payment Confirmation

After the bank transfer is received (within 1–2 business days):

A payment confirmation email is sent
Shipping preparation begins
Tracking number and link are shared with the customer

4.5 Timing of Payment

Shipment occurs only after payment clears into our bank account. Sales are prepaid.

4.6 Price Changes

Prices are not changed after the customer confirms the order. The right to change prices before confirmation is reserved.

5. Shipping and Delivery

5.1 Carriers

Products are shipped with one of the following carriers:

Aras Kargo
DHL
PTT Kargo
Yurtiçi Kargo

Carrier selection is made by Gerçeği Arayanlar based on product characteristics.

5.2 Delivery Times

Standard delivery: 3–5 business days (Istanbul and nearby)
Other provinces: 5–7 business days
Remote regions: 7–10 business days

Delivery times are estimates and not guaranteed. Carrier delays are outside Gerçeği Arayanlar’s control.

5.3 Delivery Address

Delivery is made to the address stated at checkout. Address changes are not possible after shipment.

5.4 Shipping Fees

Domestic shipping: Based on order amount (free over TRY 500)
By weight: May vary
Shipping fee: Collected with the order payment

5.5 Failed Delivery

If the customer is not home:

The courier will attempt delivery a second time
On a third failed attempt resulting in return to sender, the customer may need to pay shipping again

5.6 Damage and Loss

If the product is damaged or lost in transit:

The customer may file a claim with the carrier
Gerçeği Arayanlar will assist in resolving the issue with the carrier
If the carrier does not compensate, Gerçeği Arayanlar will replace the product

6. Right to Inspect

After delivery, the customer may inspect the product within 24 hours. During inspection:

Packaging may be opened
Features may be checked
Scent, color, and texture may be assessed

After the 24-hour inspection window:

Confirm satisfaction, or
Request a return or exchange

7. Right of Withdrawal

7.1 Definition

Under TKHK Art. 29, the customer may withdraw from the contract within 14 calendar days without giving any reason.

7.2 Withdrawal Period

Start: Date the product is delivered to the customer
End: 14th calendar day at 23:59
Weekends and holidays: Count toward the period

7.3 Exercising Withdrawal

To withdraw:

Written notice: Email hello@gercegiarayanlar.com, or
Postal notice: Send a registered letter, or
Phone: Phone notice (must also be confirmed by email)

Sample notice:

“Dear Gerçeği Arayanlar, I wish to exercise my right of withdrawal for Order #12345 and return the product.”

7.4 Return Process

After withdrawal notice is received:

The customer prepares the product in original packaging and undamaged
The product is shipped using the return label provided by Gerçeği Arayanlar
Gerçeği Arayanlar refunds payment within 14 days after receiving the product

7.5 Return Conditions

Returns accepted if:

Unused, undamaged, in original packaging
Product characteristics have not been altered
Product is in shippable condition

Returns not accepted if:

Used, broken, or punctured
Original packaging opened and crushed
Hygiene-sensitive (incense, oils)
Altered by the customer

7.6 Return Costs

Customer’s faultless withdrawal: Customer pays return shipping (unless otherwise stated in the Cancellation Policy)
Defect-based return: Gerçeği Arayanlar pays

7.7 After Return

Returned products are inspected:

If compliant: refund is issued
If non-compliant: returned to the customer with an explanation

Return-to-customer shipping in that case is covered by Gerçeği Arayanlar.

8. Defects and Warranty

8.1 Defect Claims

If the product is defective within 2 years after delivery:

The customer must notify promptly
The defect must arise under normal use
The defect should be documented with photos/video

8.2 Defects Covered by Warranty

Breakage, cracking, or deformation from manufacturing
Factory color/form defects
Functional defects in electrical/electronic products

8.3 Exclusions

User-caused damage (drops, breakage)
Improper storage (humidity, heat, sun)
Natural wear
Damage during cleaning

8.4 Warranty Process

If a defect is claimed:

Customer sends photos/video
Gerçeği Arayanlar assesses the defect
A shipping label is provided
The product is inspected and refunded or replaced

All steps complete within 30 days.

9. Contact and Complaints

9.1 Service Complaints

For service, shipping, or product quality complaints:

9.2 Alternative Dispute Resolution

Parties should first attempt mediation (TKHK Art. 68) by consent. Then:

A mediator listed by consumer associations may be engaged
Mediation costs are shared 50/50

9.3 Consumer Arbitration Committee

If mediation fails, the customer may apply to the Consumer Arbitration Committee:

Amount: Up to TRY 2,000 for the relevant committee tier
Free for consumers

9.4 Competent Court

For disputes arising from this agreement, courts at the customer’s residence or workplace are competent.

10. Legal Compliance

This agreement complies with:

TKHK (Consumer Protection Law No. 6502)
TTK (Turkish Commercial Code)
KVKK (Personal Data Protection Law No. 6698)
BTK (electronic communications rules)

11. Customer Obligations

The customer agrees to:

Provide accurate and complete personal information
Use products only for lawful purposes
Not store or resell products unlawfully
Obtain permission before using products in ads or reviews representing Gerçeği Arayanlar
